Yakin - Privacy Policy

  • This Privacy Policy is regulated by Malaysian law, except any conflict of laws provisions. Except for those individuals who may have rights to file claims under the Privacy Shield or the Swiss-US framework, you consent to the exclusive jurisdiction of the courts in connection with any action or dispute arising between the parties under or in connection with this Privacy Policy.
  • This Agreement and your use of the app will be governed by Malaysian law, excluding its conflict of laws regulations. Other local, state, national, or international laws may apply to your use of the app.
  • Thank you for supporting YAKIN (the "App"). We are constantly upgrading the App in order to improve your user experience and make it relevant for the Community. This Privacy Policy outlines how we protect your personal information when we collect, process, disclose, and use it.

  • YAKIN (“we”, “us”, or “our”) is committed to protecting the privacy of our App users (“you”, “your”, “yours”). 
  • YAKIN is published by Crescent Digital Sdn Bhd with its registered address at No.1, Level 21, Block 2A, Plaza Sentral, Jalan Stesen Sentral 5, KL Sentral, 50470 Kuala Lumpur, Malaysia, who acts as the data controller with regards the processing of your personal information.
  • This Privacy Policy (“Policy”) explains how your information is collected, processed, disclosed and used by YAKIN when you use the App and the services we provide.
  • "Personal information" in this Policy refers to information that is considered "personal data" or "personal information" (or its equivalents) under the Applicable Rules, and may include information that you provide to us when you use the App and connected services.
  • You affirm that you accept how we collect, process, disclose, and use your personal information when you use our App, subject to the Applicable Rules. Your consent will be received in accordance with the relevant Applicable Rules if the Applicable Rules require it to be obtained through other means.
  • When you use our App or the services offered through the App, we may collect, process, disclose, and use the following types of personal information that you submit or make available to us, including but not limited to:
    1. Your name, birthdate, email address, phone number, and profile picture, which you upload to or enter on the App; 
    2. Your user behaviour, such as searches or bookmarks; and other submitted items. 
    3. Any changes you make to your preferences
    4. Personal information you provide to third-party sites such as Facebook, Apple, or Google when you sign up for or log into your YAKIN account through these sites. 
  • We may collect, process, disclose, and use the following categories of personal information linked to your device and the App settings, whether or not you have a YAKIN account:
    1. Information about the device, including the manufacturer, model, operating system, and version, as well as the App version. 
    2. App activity: App pairing with a smart watch, date of App installation, date of App last use, city, state, country, IP address, time zone, language, and a "once per app installation" ID (which we generate when you install the App and then destroy when the App is deleted from your device); the name and country of your mobile operator, session duration, feature usage information, and the App's status. 
    3. Prayer location information: when you use the App for prayer times, we need to know where you are, which is determined by your geolocation information (latitude, longitude, and altitude as reported by your smartphone) or the city that you have voluntarily picked. 
    4. Your most recent prayer location information may be synchronised across all devices associated with your account if you have one.
    5. If you don't have an account with us, the prayer location data will be saved on your device and not sent to our servers. 
    6. Other geolocation information: When you use the App, various services (such as Qibla, Directory and others) require your geographical information in addition to the Prayer Times..
    7. This type of geolocation data will always be saved in your device. When you use such functions, such information is sent to our servers, but it is never stored.
    8. Our analytics service providers - Google Firebase, Google Analytics for Firebase, and Google Firebase Crashlytics - offer us with this information.
  • YAKIN may collect, handle, and utilise your information as needed to fulfil our contractual obligations to you, including to:
    1. Enable your access to and use of the App and/or the services provided through the App. 
    2. Sync your App settings, such as your most recent location information, across all of your account's devices
    3. Keep you informed about changes to the App, such as software upgrades and services, as well as reply to your questions.. 
    4. Give your cell provider, the Apple App Store, or the Google Play Store permission to bill you.:
      1. YAKIN may additionally collect, process, disclose, and use your information, either directly or through the use of third-party Software Development Kits (SDKs), in order to further our legitimate interests, such as:. 
      2. Personalize your experience, for example, by displaying material that is relevant to your interests and preferences. 
      3. Make sure you're only seeing the most relevant ads on the App.

  • You are now notified that, due to the religious character of the App, we may infer sensitive personal information about you, including your religious beliefs. You acknowledge that the collection and processing of such data is inextricably tied to your usage of the App and the services we provide. As a result, if you refuse to allow us to gather such sensitive personal data, you will be unable to use the App. 
  • End User Data will be collected by YAKIN in order to provide YAKIN services to our clients. 
  • End users may give us with information they have made available on social media networks voluntarily. We may collect publicly available information from the social networking websites you have identified if you supply us with such information. By visiting these websites and updating your privacy settings, you can manage how much of your information is made public on social media networks. 
  • When you contact us, we receive some information from third parties. When you submit your email address to us to express interest in becoming a YAKIN customer, for example, we obtain data from a third party that offers YAKIN with automatic fraud detection services. We also gather information that is made publicly available on social networking networks on occasion. By visiting these websites and updating your privacy settings, you can manage how much of your information is made public on social media networks. 
  • We may share both personal and non-personal information collected with third parties such as advertisers, contest sponsors, promotional and marketing partners, and others that offer our content or whose products or services we believe may be of interest to you. We may also share it with our existing and future connected firms and business partners, and we may share or transfer your personal and non-personal information to our successors-in-interest if we are involved in a merger, asset sale, or other corporate reorganisation. 
  • We may use trusted third-party service providers to perform functions and provide services for us, such as hosting and maintaining our servers and the app, database storage and management, e-mail management, storage marketing, payment processing, customer service, and fulfilling orders for products and services available through the app. We will very certainly share your personal information, as well as maybe some non-personal information, with these third parties in order for them to provide these services to us and to you.

  • We only keep your information for as long as we need it to provide you with YAKIN and to accomplish the goals outlined in this policy. This also applies to anybody with whom we disclose your information or who performs services on our behalf. When we no longer need to use your information and we don't need to keep it to meet our legal or regulatory obligations, we'll either delete it or depersonalise it so that we can't identify you.

  • You may also file a complaint with the competent data protection authority in your country whenever you consider that the processing of your personal information does not comply with the Applicable Rules. 
  • When we make changes to this Policy, we will notify you via the App or email. You have the option to reject the modifications, but you may lose access to any or all of the App's features.
